全國貨主、貨代企業(yè):
碼頭作業(yè)費(fèi)(THC)問題經(jīng)過調(diào)查機(jī)關(guān)兩年多的調(diào)查,同時(shí)經(jīng)過咨詢專家組的論證,調(diào)查機(jī)關(guān)終于在2006年4月20日公布了THC調(diào)查結(jié)論,主要內(nèi)容如下:
Main contents of the THC Investigation Conclusion is as follows:
一、THC在性質(zhì)上屬于國際集裝箱班輪運(yùn)費(fèi)的組成部分;
THC is a component part of the freight in international container liner transportation;
二、班輪公司集體訂立運(yùn)價(jià)協(xié)議不得對公平競爭和國際海運(yùn)市場秩序造成損害;
The collective agreements of the liners shall not be detrimental to the fair competition and disturb the order of international shipping market.
三、以聯(lián)合通知或公告的方式宣布同時(shí)按相同的標(biāo)準(zhǔn) 在我國收取碼頭作業(yè)費(fèi)客觀上限制了托運(yùn)人自由選擇承運(yùn)人的權(quán)利,在一定程度上損害了國際海運(yùn)市場秩序。類似行為要禁止再次發(fā)生,對于訂立集體運(yùn)價(jià)協(xié)議但沒有依法履行備案手續(xù)的班輪公會成員和國際班輪運(yùn)輸經(jīng)營者,要予以處罰;
The joint collective agreements or notices limit the right of shippers to choose carriers freely. It is not good for the normal price competition among liner companies and disturbed the order of the international shipping market to a certain extent. Such practice can not be happened again in the future, penalty will be imposed on the members of liner conferences and freight discussion agreements who had reached the collective freight agreements but failed to fulfill the required filing procedures;
四、要建立船貨雙方的有效協(xié)商機(jī)制,對共同關(guān)心的事項(xiàng)進(jìn)行充分有效的協(xié)商;
Consultation mechanism should be set up between carriers and shippers for the purpose of full and effective consultation on issues of mutual interests before the implementation of freight agreements and various surcharge agreements;
五、在中國收取碼頭作業(yè)費(fèi)的班輪公司沒有按照交通部2002年12月30日公告要求報(bào)送材料的國際班輪運(yùn)輸經(jīng)營者,要予以處罰;
Penalty will be imposed to those international liner operators who collected terminal handling charges at Chinese ports and failed to submit their reports as required.
六、班輪公司扣發(fā)提單和貨物的問題,通過司法等途徑解決。
If the liner companies detain bills of lading and cargoes, shippers can seek settlement of the case through judicial channels.
我們認(rèn)為調(diào)查結(jié)論是公平、公正的。調(diào)查機(jī)關(guān)明確“THC在性質(zhì)上屬于國際集裝箱班輪運(yùn)費(fèi)的組成部分”,從法理和邏輯上表明,班輪公司不能在運(yùn)費(fèi)之外再另收THC,貨主、貨代可據(jù)此拒付THC,如班輪仍然強(qiáng)行收取THC,扣發(fā)提單或扣貨,可起訴班輪公司。希望貨主和處在第一線的貨代企業(yè)理直氣壯地拒付不合理的THC,以維護(hù)貨主、貨代企業(yè)本身的合法權(quán)益和調(diào)查結(jié)論的尊嚴(yán)。
According to article 1 of the Conclusion, Liners can not charge THC separately from the freight from the shippers or consignees, shippers can reject THC, if liners insist to collect THC and detain bill of lading or cargo, the shippers can file such case to the court for settlement.
